Terms & Conditions

    1. I hereby agree to occupation Of the house for my use as short-term holiday accommodation for the period as set out in the attached confirmation/ rental agreement and agree to pay the full balance prior to occupation.
    2. The advance rental shall be non-refundable and non-transferable to another date, in the event of cancellation for whatsoever reason by the tenant.
    3. The security / breakage deposit, if any, shall be refunded to the tenant as soon as the the Landlords (herein referred to as “the owners’), and / or their appointed rental agents (herein referred to as their “agent(s)”), and / or their housekeeper and / or any other appointed persons / entities (herein referred to as their “representatives’) has determined that the rental property has been returned in good order and any additional costs for the tenant’s account have been finalised. Any extra costs incurred to replace, repair or recover broken / damaged / missing items which exceed the initial breakage deposit amount, will be paid in addition by the tenant upon receipt Of an invoice from the agent(s) and / or their representative.
    4. OVER-CROWDING IS NOT PERMITTED:The number of people permitted to occupy the premises shall be limited to 10 (ten) persons and no extra person(s) may occupy the premises without first obtaining written consent from the owners and / or the agent(s)
      The introduction of extra persons as occupants, without such consent, shall lead to immediate cancellation of this agreement and eviction of the tenant(s) and / or any person(s) occupying the property, or any part thereof under the contractual tenant’s name, through access granted by the contractual tenant, or directly invited by the contractual tenant to share occupation, or occupation by any extra person(s) directly replacing the contractual tenant, without consent from the owner and / or their agent (s).
    5. Please note that there is no telephone (landline) in the house. Please to bring your own mobile or cellular phone.
    6. Towels provided on the premises may not be removed Please provide your own beach, pool and other recreational towels.
    7. The home is serviced from 10:00 daily by the resident housekeeper. The housekeeper’s functions are detailed in our House Rules, Of which a copy will be provided Please note that these housekeeping services are intended to maintain the property to the living standards acceptable to prospective tenants, on behalf of the owners. Housekeeping services exclude extra personal service requests by and work for / on behalf of tenants, their guests or visitors. The resident housekeeper does not work on Sunday and or any Public Holidays.
    8. No smoking is permitted inside the home. Ashtrays are available outside for this purpose.
    9. No prohibited substances or articles may be brought onto, used or traded with on the premises.
    10. No pets are allowed in or on the premises.
    11. No parties or noise after 22:00 will be tolerated. Tenants will be required to adhere to the house rules, to respect the neighbours, regulations and mandates that govern this property, the residential area and bordering private spaces.
      Non-compliance with this regulation and mandate will result in immediate cancellation of this agreement and eviction.
    12. During the period of occupation, the tenant shall keep the premises and content thereof in good order and condition and, upon termination of the rental period, the tenant shall return the entire house, its contents and the property in the same good order and condition handed over to the tenant for occupancy.
    13. All furniture, fittings and accessories on the property are accepted as being in “voetstoots” condition upon occupation by the tenant and shall be left in the same good order and condition upon termination of the rental term, fair wear and tear accepted.
    14. If, for any reason, the tenant found cause to rearrange the property’s furniture, the tenant undertakes to move the furniture back to their original positions prior to departure. Should the owners, or any Of their agents or representatives incur any financial cost to return furniture to their original positions; or should any damage to the property, or its furniture, be caused by such rearrangement, this will be deducted from the tenant’s refundable breakage deposit. Should the costs exceed the breakage deposit, this will be invoiced to the tenant for immediate settlement.
    15. Check-out time is strictly by 08:30.
      Your co-operation would be appreciated. This allows us time to prepare the property for the arrival of our next guests / tenants.Late departures will result in an additional fee being levied, at R350 per hour, due to the fact that staff members need to tend to the property outside of their normal routine after your delayed departure.
    16. Check-in time is strictly from 14:00 onwards and not before.
    17. Keys for the premises shall be collected from and returned to the agent or the housekeeper during normal business hours, unless special arrangements to the contrary have been made.
    18. A minimum fee of R500.OO will be charged for keys / remote controls not returned to the office and / or agent(s) and / or the housekeeper on departure date.
    19. The owners, their agent(s) and / or representatives and the property home owners cannot be held responsible for unforeseen events, such as interruption or non-availability of services offered by independent service providers to the properties, such as wireless internet services, TV and satellite services, pool maintenance services and electricity and water supplies, etc. This includes any unforeseen delays in repairs of faulty electrical appliances.
    20. NOTICE OF INDEMNITY:
      (The owners and / or agent(s) and / or housekeeper accept no liability whatsoever in respect of any theft, loss, damages or injury to the tenants, whether caused by any negligence on our part, or that of ourselves, management, agents, representatives, staff or otherwise.
    21. JURISDICTION:
      The tenant hereby chooses domicilium citandi et executandi for all purposes at the premises indicated on the rental agreement and accepts the jurisdiction of the Magistrate’s Court closest to the Owner’s physical address, for the purpose Of containing legal expenses.
      In respect of any action instituted against him/her, legal costs will be calculated at the current attorney-client scale, including collection commission.
    22. CONCESSIONS:
      NO concession(s), made by the owners and / or the agent(s) and I or the housekeeper to a tenant may, in any manner or form, be considered a deviation from our standard rental agreement / contract, nor from the terms and conditions contained within the contract.
      PAYMENTS AND REFUNDS:
    23. Refundable security / breakage deposits are not refunded immediately upon departure. The refunds are subject to property inspection, which may be scheduled a minimum Of 48 hours after termination Of the rental agreement. Refunds may take up to 7 days thereafter to process.
    24. In the event of the rental term being reduced by a tenant, regardless of the reason, no refund will be given to the tenant.
    25. The tenant acknowledges that the 1st upfront payment (50% Advance Deposit and the Booking Fee) is non-refundable and herewith authorisers the agent(s) to deduct their pro-rata commission from this first payment, once It has been received, where after the balance is paid by the agent(s) to the owners.
    26. We have no card facilities, therefore payments in lieu of this contract and / or any additional fees can by made by electronic transfer, bank transfer, or cash deposit into our account. Please submit proof of such payment(s). Any agreement(s) will only be considered binding once the funds reflect in our account.
